Every long term care insurer shall maintain a record of all policy or certificate rescissions, and shall annually furnish this information to the commissioner, which shall include the reason for rescission, the length of time the policy or certificate was in force, and the age and gender of the insured person. The commissioner may make public the aggregate data collected.
Exceptions to access to individually identifiable information: (1) the administrative director or a statistical agent may use information for a workers' compensation information system, (2) the Department of Health Services may use information for an occupational health and occupational disease prevention program, (3) the Division of Workers' Compensation, the Division Occupational Safety and Health, and the Division of Labor Statistics and Research may access information to the extent necessary to perform their duties, (4) persons and entities with legitimate statistical research purposes may
Unless otherwise provided, information acquired in administering this code is confidential and for the exclusive use and information for the director to carry out his duties. Information permitted to be disclosed is not admissible as evidence in any proceeding except as provided in this code. Information may be used for statistical purposes so long as the names of the employers and workers are not revealed.
All applications and records for any public social services which grants-in-aid are received shall be confidential, unless otherwise excepted in this section. Such information is only open to examination for purposes directly connected to the administration of the program, or any investigation, prosecution, or criminal or civil proceeding connected to the administration of any such program. Disclosure of information that identifies by name or address of any applicant for or recipient of grants-in-aid to any committee or legislative body is prohibited except as listed.
Confidential information as listed under Welfare and Institutions Code 14100.2(b) must be disclosed to the Joint Legislative Audit Committee and the State Auditor. The LAC and the State Auditor may use the information for the purposes of auditing or investigating the Medi-Cal program, Chapter 8, or 8.7. In the event of such authorized disclosures the information shall not be used for commercial or political purposes and the identity of applicants and recipients shall not be disclosed, except in criminal or civil proceeding connected with the administration of the Medi-Cal program.
The Department of Health Services may make rules and regulations governing the custody, use, and preservation of all records, papers, files, and communications pertaining to the administration of the laws relating to the Medi-Cal program, prepaid health plans, and adult day health care programs.
All information and records acquired while providing services to voluntary or involuntary recipients shall be confidential. Such information and records may be disclosed to (a) State Department of Health Services authorized persons, and to authorized legal staff or special investigators who are employed by or authorized representatives of the State Department of Social Services as is necessary to perform their duties of inspecting, licensing, and investigating facilities.
The State Department shall publish annual reports about the operation of this division. Each local mental health director and each facility providing services pursuant to this division shall provide the Department any information, records and report which the department requests and finds necessary for such report. The department shall not have access to any patient name identifiers.
This law exempts indices of birth, death and marriage records from disclosure under the Public Records Act. The State Registrar may release comprehensive birth, death, and nonconfidential marriage record indices to a government agency. The State Registrar is required to establish separate non-comprehensive indices for public release. Requesters of the indices must provide proof of identity and sign a form certifying that they will comply with prescribed usage guidelines.
