An applicant for a license to practice marriage and family therapy must have at least 3000 hours of training experience, including some direct supervisor contact. All applicants must be supervised, and that supervisor is responsible for compliance with all laws, rules and regulations regarding the practice of marriage and family therapy. An applicant working in a governmental entity, a school, a college, or a university, or an institution that is both nonprofit and charitable may obtain the required weekly direct supervisor contact via two-way, real-time videoconferencing.
In an investigation and prosecution of sexual exploitation by physicians, surgeons, psychotherapists, or alcohol and drug abuse counselors – cannot obtain disclosure of any confidential files of other current or former patients/clients of the individual under investigation.
The results from any test may be provided directly to the person requesting the test if the test concerned that person. These test results shall be clearly presented and indicate whether there is a need for referral to a physician and surgeon.
Within 30 days after the death or incapacity of a dentist, the contracting dentist or dentists shall send notification of the death or incapacity by mail to the last known address of each current patient of record with an explanation of how copies of the patient's records may be obtained. After a committee in its discretion has determined that a dentist licentiate has been rehabilitated and the diversion program is completed, the committee shall purge and destroy all records pertaining to the licentiate's participation in a diversion program. Treatment records are confidential.
Any person applying for a license or the renewal of a license as a professional boxer or martial arts fighter must present HIV and hepatitis C antibody and hepatitis B antigen tests to the commission. Information received under this section and any other medical information about an applicant or licensee shall be confidential and not subject to discovery or subpoena
