Summary:

A licensed dental hygienist must comply with a court order mandating the release of records to the Dental Hygiene Committee. Unless it is determined that the order is unlawful or invalid, failure to comply results in a civil penalty to be paid to the committee and constitutes unprofessional conduct that is grounds for suspension or revocation of his or her license; the licensee is also guilty of a misdemeanor punishable by a fine.

Bus. & Prof.Code 1955(b): civil penalty of one thousand dollars ($1,000) per day for each day that the documents have not been produced after the court ordered date; a misdemeanor punishable by a fine payable to the committee not to exceed five thousand dollars ($5,000); 1955(c): Multiple acts by a licensee in violation shall be punishable by a fine not to exceed five thousand dollars ($5,000) or by imprisonment in a county jail not exceeding six months, or by both that fine and imprisonment.
