Penal Code 1370.01(a)

Summary:

(a) If the defendant is found to be mentally incompetent, judgment shall be suspended until mental competence is recovered. The defendant shall be placed in a treatment facility or on outpatient status. When a certificate of restoration is filed, the defendant shall be returned to court and the county mental health director shall be notified of the order. Before ordering the defendant confined or placed on outpatient status, the court shall order the county mental health director to evaluate the defendant and submit a written recommendation as to placement to the court. The court shall hear and make a determination regarding the defendant and antipsychotics. If the court finds that antipsychotics should be administered involuntarily, an order should be issued authorizing the treatment facility to do so.
