The California Privacy and Security Advisory Board (CalPSAB) Privacy Committee will establish and maintain patient privacy standards for the exchange of health information consistent with California and federal laws.

The Committee is composed of industry and consumer representatives with privacy policy, technical and clinical expertise. The current committee membership consists of over thirty clinicians, healthcare administrators, technical experts, policy advocates, patient privacy specialists, and concerned community members.

The Privacy Committee utilizes task groups to do focus work on specific issues.

Applicability Joint Task Group

The Applicability Task Group was formed to determine how to apply electronic health information exchange (eHIE) standards to safeguard an individuals’ health information. The task group is currently deciding from four alternatives how entities will apply the standards. The four options under consideration are applying the standards: 1) based on data fields; 2) based on categories of data use; 3) to HIPPA-covered entities only; or 4) to all entities who handle individually identifiable health information. Additionally, the task group will consider a blend of various alternatives.

Baseline Standards Task Group

The Baseline Standards Task Group is evaluating core existing sets of privacy standards including Health Insurance Portability and Accountability Act (HIPAA) and various California laws. It will recommend a single or blended set of existing privacy standards that will form a base for privacy standards analysis and proposals.

Consent Task Group

The Consent Task Group is identifying alternatives available to patients to control their personal health information that is subject to electronic health information exchange in different health care situations. Their goal is to provide a proposal to the Committee that balances the providers need for health information with the patients’ rights to privacy while taking into consideration the laws that protect specified health information.
