Legal Committee Overview:

The mission of the Legal Committee is to provide legal input to the CalPSAB and its committees for California Health Information Exchange (HIE) by sharing legal expertise to identify issues, to enhance understanding of legal issues and to offer alternative methods of resolution.

Their objectives are to:

  • Assist in the California Health Information Law Identification (CHILI) project by reviewing the CHICO spreadsheet for completeness and accuracy of the state provision's summary and relevance to the HIPAA.
  • Review and provide comment to CalOHI's preemption analyses and determine which provisions of state law concerning personal medical information are preempted by HIPAA. [Harmonize state laws]
  • Provide input to the committees to help insure that the laws are accurately and consistently interpreted throughout the process of formulating solutions, planning, and implementation.
  • Assist the CalPSAB committees in identifying state and federal laws that may be consistent or inconsistent with the alternative standards.
  • Analyze and identify legal issues that are encountered by the CalPSAB committees.
  • Be a resource on the evolving law concerning privacy and security.
